1. Agreement and eligibility
These Terms form an agreement between the Shopify merchant accepting them and AI Pocket Pal. You must have authority to bind the merchant, maintain an eligible Shopify store and use the service in compliance with Shopify’s terms and applicable law.
2. The service
AI Pocket Pal provides an AI-assisted storefront sales and support experience, merchant configuration, knowledge synchronization, live support tools and analytics. Features can depend on the merchant’s Shopify plan, market configuration, theme, granted scopes, third-party providers and selected AI Pocket Pal plan.
3. Merchant responsibilities
- Provide accurate store, policy, catalog and support information.
- Review AI configuration and test behavior before publishing.
- Provide required shopper notices and obtain required consent.
- Configure staff access, market coverage and support channels responsibly.
- Not use the service for unlawful, deceptive, harmful or rights-infringing activity.
- Not probe, bypass, reverse engineer or interfere with service security or usage controls.
4. AI outputs
AI output can be incomplete or incorrect. The service includes retrieval and commerce safeguards, but merchants must evaluate whether it is appropriate for their catalog, policies and regulated use cases. AI Pocket Pal does not provide legal, medical, financial or other professional advice, and merchants must not configure it to do so.
5. Fees, trials and usage
Plans, billing interval, trial and charges are displayed through Shopify before approval. Current allowances are measured under the applicable plan. Additional credits or bundles, when offered, are granted only after Shopify purchase verification. Shopify manages subscription billing, cancellation and applicable refunds subject to its platform rules and the accepted charge.
6. Merchant content and license
The merchant retains rights in content supplied through Shopify or uploaded to the service. The merchant grants us a limited license to host, index, transform and process that content solely to provide, secure and improve the service. The merchant confirms it has the rights and authority required for that use.
7. Intellectual property
AI Pocket Pal and its software, design, documentation and service technology remain our property or that of our licensors. These Terms grant a limited, non-exclusive, non-transferable right to use the service during an active authorized subscription.
8. Availability and changes
We aim to operate a reliable service but do not guarantee uninterrupted or error-free availability. We may change features to improve safety, platform compatibility or performance, and may suspend access to prevent harm, address non-payment, comply with law or enforce these Terms.
9. Confidentiality and data protection
Each party will protect non-public confidential information and use it only for the agreement. Personal data is handled under the Privacy Policy, applicable data-processing terms and Shopify requirements.
10. Warranties and liability
To the maximum extent permitted by law, the service is provided “as is” and implied warranties are disclaimed. Neither party is liable for indirect, incidental, special or consequential loss. Our aggregate liability arising from the service will not exceed amounts paid for the service in the twelve months before the event giving rise to the claim, except where liability cannot lawfully be limited.
11. Termination
The merchant may stop using the service and uninstall through Shopify. We may terminate or suspend for material breach, legal or security risk, or discontinued operation. On termination, rights to use the service end and data is handled under the Privacy Policy and applicable legal obligations.
12. General terms
Neither party may assign the agreement without consent except in connection with a merger, acquisition or sale of substantially all relevant assets. Events outside reasonable control excuse delay while they continue. If a provision is unenforceable, the remainder continues. The parties will first attempt in good faith to resolve disputes through written notice to support@mg.aipocketpal.com, without limiting rights that cannot be waived.
